Welcome to RoleCall Job Evaluation Platform ("the Platform"). These Terms and Conditions ("Terms") govern your use of our job evaluation services, software, and related documentation provided by RoleCall ("we", "us", or "our") to you ("User", "you", or "your").

By accessing or using the Platform, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Platform.

2. Definitions

• "Platform" refers to the RoleCall job evaluation software and all associated services.
• "Organization" refers to the theatre company or entity subscribing to our services.
• "Evaluation" refers to the job position assessment process using our framework.
• "User" refers to any individual authorized to access the Platform.
• "Content" refers to all data, text, information, and materials uploaded to the Platform.

3. Service Description

RoleCall provides:

• Job evaluation framework based on 10 weighted dimensions
• Multi-evaluator assessment capabilities (HR, Manager, Employee, External, AI)
• Job banding system (B1-B9) tailored for UK theatre organizations
• Analytics and reporting tools for position management
• AI-powered evaluation assistance using GPT-4 technology
• Secure data storage and management

4. Account Registration & Security

To use the Platform, you must:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access or security breach
• Be responsible for all activities under your account
• Not share your account with unauthorized individuals

We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk to the Platform.

5. Acceptable Use Policy

You agree not to:

• Use the Platform for any unlawful or discriminatory purposes
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to any part of the Platform
• Interfere with or disrupt the Platform's operation
• Reverse engineer or attempt to extract source code
• Use automated systems or bots without permission
• Violate any applicable laws or regulations

6. Data Protection & Privacy

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your information.

You acknowledge that:

• We comply with UK GDPR and data protection regulations
• You have necessary rights to upload and process employee data
• You will obtain appropriate consent for external evaluators
• Data may be processed using AI services (OpenAI GPT-4)

7. Intellectual Property

The Platform, including all software, designs, text, graphics, and content, is owned by RoleCall and protected by intellectual property laws.

You retain ownership of your organization's data uploaded to the Platform. By using the Platform, you grant us a license to process and display your data as necessary to provide our services.

8. Payment & Subscription

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are in British Pounds Sterling (£) unless otherwise specified
• Payments are non-refundable except as required by law
• We reserve the right to modify pricing with 30 days notice
• Late payments may result in service suspension

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROLECALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.

10. Warranties & Disclaimers

The Platform is provided "as is" and "as available". We make no warranties, express or implied, regarding the Platform's operation, availability, or fitness for a particular purpose.

While we strive for accuracy in our AI evaluations and analytics, results should be used as guidance alongside human judgment and organizational policies.

11. Indemnification

You agree to indemnify and hold harmless RoleCall, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

12. Termination

Either party may terminate this agreement:

• With 30 days written notice
• Immediately for material breach
• As required by law or regulation

Upon termination, your access will be revoked and you may request data export within 30 days.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or Platform announcement with at least 30 days notice. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
